Terms of Service

1. Acceptance

These Terms of Service (“Terms”) are an agreement between you and Cephra LLC, a California limited liability company (“we”, “us”) covering the WingPath iOS app and the wingpath.app websites (together, the “Service”). By downloading or using WingPath, you accept these Terms. If you don't agree, don't use the Service.

2. The service

WingPath is a learning app for airport, airline, and route codes. No account or registration is required or offered; your progress is stored on your device and, optionally, in your private iCloud. We may add, change, or retire features over time, and we'll communicate material changes in release notes.

Changes to and discontinuation of the Service. We may modify, suspend, or discontinue any part of the Service at any time. If we discontinue WingPath entirely, we will give reasonable advance notice through the app or its release notes where practicable. Because the app stores your learning data on your device and in your private iCloud, that data remains yours regardless of the Service's availability.

3. Eligibility

You must be at least 13 years old (or the equivalent minimum age in your country) to use WingPath.

4. License

Your download and use of the app itself is licensed under Apple's standard Licensed Application End User License Agreement. These Terms apply in addition to it and govern the Service — the websites, the API, and your relationship with us. If these Terms and Apple's standard EULA conflict regarding the app license, Apple's standard EULA controls.

5. Subscriptions & purchases

WingPath offers an optional paid tier, WingPath Pro:

• Auto-renewing subscriptions (monthly or annual) are billed to your Apple Account at confirmation of purchase and renew automatically until cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your device's Settings under your Apple Account > Subscriptions; cancellation takes effect at the end of the paid period.
• Lifetime unlock is a one-time, non-renewing purchase that unlocks Pro features for as long as WingPath remains available. “Lifetime” refers to the lifetime of the app, not a personal guarantee. We will not remove a Pro feature you unlocked with a lifetime purchase without providing a reasonable equivalent, and if we ever discontinue WingPath we will give reasonable notice.
• Prices are shown in the app before purchase and may vary by region. If prices change, Apple notifies you and, where required, asks you to consent before a renewal at a new price.
• All billing, refunds, and payment issues are handled by Apple — request refunds at reportaproblem.apple.com. We don't receive your payment details and can't issue refunds directly.
• Use “Restore Purchases” in the app to re-enable Pro on a new device.

Free-tier limits (such as the daily session cap) and the exact features included in Pro are described in the app and may evolve.

7. Acceptable use

You agree not to:

• copy, scrape, bulk-export, or redistribute the WingPath airport/airline/route database;
• access our API other than through the app, or probe, overload, or disrupt our services;
• reverse engineer, decompile, or modify the app, except where the law permits despite this clause;
• resell, rent, or commercially exploit the Service without our written permission;
• use the Service in violation of applicable law.

8. Intellectual property

WingPath — including the app, its design, the compiled and curated airport database, and the WingPath name and marks — is owned by Cephra LLC and protected by law. Airport and airline codes themselves are factual information; our protection covers our curation, compilation, and presentation. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation.

9. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that the data will be accurate. Some jurisdictions don't allow these exclusions, and nothing in these Terms limits statutory consumer rights that cannot be waived — including for consumers in the EU and UK.

10. Limitation of liability

To the maximum extent permitted by law, Cephra LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost data or profits, arising from your use of the Service. Our total liability for all claims is capped at the greater of US$50 or the amount you paid us in the 12 months before the claim. This cap doesn't apply where the law forbids limiting liability — for example, for gross negligence, willful misconduct, or rights that consumer law makes non-waivable.

11. Indemnification

You agree to reimburse us for reasonable costs and damages arising from claims caused by your violation of these Terms or misuse of the Service, to the extent attributable to you.

12. Termination

You can stop using WingPath anytime by deleting the app (see how to delete your data). We may suspend or terminate access to the Service for breach of these Terms. Sections 6–11 and 13–16 survive termination.

13. Apple-specific terms

For WingPath downloaded from the App Store:

• These Terms are between you and Cephra LLC only — not Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to conform to an applicable warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• We, not Apple, are responsible for addressing any product, legal, or regulatory claims relating to the app, including product liability, consumer protection, and IP claims.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and are not on any U.S. Government restricted-party list.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.
• Questions or claims about the app go to us via the contact form at wingpath.app/support.

14. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You and Cephra LLC agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within California to resolve any dispute or claim arising from these Terms.

If you are a consumer in the EU, UK, or another jurisdiction with mandatory consumer protections, you keep the protection of your local law and the right to bring proceedings in your local courts.

15. Changes to these terms

We may update these Terms as the Service evolves. For material changes we'll update the effective date above and give notice in the app or its release notes before the changes apply. Continuing to use WingPath after changes take effect means you accept them.

16. Miscellaneous

If a provision of these Terms is found unenforceable, the rest remain in effect. These Terms (plus the privacy policy and Apple's standard EULA) are the entire agreement between us about the Service. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
